altECOWAS COMMISSION PRESIDENT ASSURES NEW JUDGES OF SUPPORT TOWARDS THE REALISATION OF THEIR MANDATE

The new Judges of the ECOWAS Community Court of Justice have been enjoined to demonstrate ‘the highest level of consciousness and probity’ in the handling of cases brought before them in order to ensure fidelity with their oath of office.

At the handover ceremony to the new President of the Court, the President of the ECOWAS Commission, His Excellency Jean-Claude Brou, said as one of the institutions created under the founding Treaty, the Court by its mandate has a responsibility to ensure respect for Community texts, the rule of law and equity.

alt HON. JUSTICE EDWARD ASANTE EMERGES NEW PRESIDENT OF ECOWAS COURT

Honorable Justice Edward Amoako Asante from Ghana was on Monday, 27th August 2018 elected the President of the Community Court of Justice for a two year tenure by the five newly appointed judges of the Court.


Justice Asante replaces Honorable Justice Jérôme Traoré from Burkina Faso, who just completed his two year tenure and who along with the other former six judges of the Court, have completed their four year term.

altCOURT DISMISSES CASE RELATING TO BOUNDARY DISPUTE ALREADY RESOLVED BY NIGERIA’S SUPREME COURT

The ECOWAS Community Court of Justice has dismissed a suit in which a Nigerian community had asked for the Court’s intervention in the resolution of a boundary dispute with a neighboring community in a case that had been resolved by the country’s Supreme Court.

In the decision read by Justice Chijioke Nwoke, the Court declared the case inadmissible on the grounds that the matter bordered on municipal boundary conflict which did not fall within its jurisdiction particularly its human rights mandate as claimed by the plaintiffs.

alt ECOWAS COURT DISMISSES CASE FOR THE ENFORCEMENT OF DECISION OF NATIONAL COURT

The ECOWAS Court has dismissed as ‘inadmissible,’ a suit filed by Finance Investment and Development Corporation Inc. (FIDC) against the Republic of Liberia.

In dismissing the suit, a panel of three Justices of the Court, presided by Hon. Justice Friday Chijioke Nwoke, declared that the claim has been overtaken by the decision of the Supreme Court, as the ECOWAS Court is not an appellate Court over decisions of national courts of Member States.
