REGIONAL COURT ORDERS ECOWAS COMMISION TO PAY DEBT TO NIGERIAN COMPANY

West Africa’s regional court has ordered the ECOWAS Commission to pay N20, 698,920 to a Nigerian company, Vision kam Jay Investment Limited, being the balance of the contract sum of goods and services rendered to the Commission by the company since 15th December 2014.


Delivering judgement in a case brought by the company for a breach of contract, the ECOWAS Court of Justice also ordered the Commission to pay the company one per cent interest per day on the outstanding debt until its liquidation beginning from 16th April 2015.


In suit no ECW/CCJ/APP/37/15, the plaintiffs said it won a contract for the supply, installation and maintenance of power and associated equipment in support of the Commission’s SAP infrastructure in the sum of N56, 415,422 based on a contract signed on 21st November 2014.


The company further said that following the completion of the contract within the four weeks stipulated in the contract, it received only N35, 716,422 while the Commission has ‘failed and refused’ to offset the outstanding despite several efforts resulting in the withdrawal of its operational licence by its US partner.


The plaintiff had also asked the Court to award 500 million in general damages against the Commission and pay a 10 per cent interest on the outstanding from 16th April 2015 until the liquidation of the debt.


Honourable Justice Chijioke Friday Nwoke, who read the judgement said it was satisfied with the documents submitted by the plaintiff to buttress its claim about the contract and the status of the payment but rejected the claim for general damages.


The Court advised the defendant to ’exhibit some measure of responsibility and commitment in executing contracts entered into by the Institution in future,’ and blamed the ‘laxity’ of some of the Commission’s officials for the loss suffered by the plaintiff.
